Terms & Conditions

1. Who we are. LocaNest is a sole-proprietorship platform operated by Aman Saini, based in Jaipur, Rajasthan, India, offering a rental-property listing and reservation service. Registered contact: official@locanest.in.

2. What we do. LocaNest facilitates discovery, chat and platform-managed reservation of rental properties. We are not a party to the tenancy between owner and tenant.

3. Eligibility. You must be 18+ and legally able to enter into a rental transaction. Owners must provide truthful listing information and successful verification of identity/business documents.

4. Deal completion — offline-deal policy. All deals discovered on LocaNest must be completed through the platform. Completing deals offline strips both parties of platform protections — no verified agreement, no dispute support, no ratings, and no payment protection. If either party is found bypassing the platform (via chat monitoring, reports, or admin review), both accounts may be permanently banned at our discretion.

5. Payments & subscription. All advance, token and subscription payments on LocaNest are processed by Cashfree Payments (our licensed PA/PG). We do not store card / bank credentials. Advance amounts, short-stay balances, subscription renewals, tenant cancellations and owner-rejection refunds are governed by our Refund & Cancellation Policy, which is incorporated into these Terms by reference.

6. Content. You retain ownership of the property photos and descriptions you upload, and grant LocaNest a limited license to display them on the platform. You represent that you have the right to publish them.

7. Prohibited activity. Fraudulent listings, scraping, bot behaviour, spam, harassment, impersonation, and any attempt to circumvent verification or contact-gating are prohibited and can lead to account suspension or permanent ban.

8. Limitation of liability. LocaNest is a listing intermediary and does not guarantee the accuracy, legality, safety, condition, or availability of any listing, owner, or tenant. Property visits, title checks, rent-agreement review and independent legal advice remain the user’s responsibility. To the maximum extent allowed by applicable law:

• We are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of rent, business, profit, data or goodwill.
• Our aggregate liability to any user, for any and all claims arising out of or relating to the platform, is limited to the total platform fees actually paid by that user to LocaNest in the trailing 6 months, or ₹5,000, whichever is lower.
• We are not responsible for any offline agreement, cash transaction or side-deal completed outside LocaNest.

9. Account termination. Beyond suspensions for fraud or platform-abuse, we may — at our sole discretion and with reasonable notice where practicable — suspend, restrict or terminate your account for: (a) repeated policy violations, (b) prolonged inactivity, (c) chargebacks or payment disputes, (d) court / regulator order, (e) discontinuation of the service or the affected feature, or (f) any other legitimate business reason. On termination we will retain records only as long as required for legal, tax and audit compliance (see Privacy Policy). You may close your account at any time by writing to official@locanest.in; any active bookings, payouts or disputes will be resolved before deletion.

10. Changes. We may update these Terms; the “Effective date” at the top will be revised and material changes will be communicated to registered users by email and via an in-app notice at least 7 days before they take effect. Continued use after that date means you accept the revised Terms.

11. Governing law & jurisdiction. These Terms and any dispute or claim (including non-contractual disputes) arising out of or in connection with the platform are governed by, and construed in accordance with, the laws of India. Subject to any mandatory law to the contrary, the parties irrevocably submit to the exclusive jurisdiction of the courts at Jaipur, Rajasthan, India.
